Music Grant Inc.'s platforms and services are not directed to children under the age of 13. If you are not 13 years of age or older, you are not permitted to use our platforms or submit any data to us. Additional Client & Partner Disclosures

If you are an independent artist or label client engaging with Music Grant’s client-facing Site(s), services, tools, or apps, we may collect the following additional categories of personal information to fulfill our commercial contracts:

  • Business Registry: Your trading or company name and business registry number (if applicable).

  • Corporate Representative Data: Contact information of authorized representatives and employees, including name, email address, street or mailing address, and telephone or mobile phone number.

  • Financial Records: Accounts payable information, which may include bank account details and applicable tax forms.

  • Identity Verification Documents: Limited identification documents, such as a passport or driver's license, and proof of address, such as utility bills or credit card statements.

  • Vetting Information: Information provided on identification documents, such as nationality, gender, date of birth, and place of birth.

  • Tax & Government Identifiers: Social Insurance Number (SIN), Social Security Number (SSN), or similar regional government tax identifiers required strictly for tax compliance and payout processing.

  • Legal Attestations: Your and/or your authorized representative(s)’s and/or witness’ signature(s).

  • Certifications: Your or your authorized representative’s contact details as provided on applicable registration certificates.

Third-Party E-Commerce and External Merchants

You may purchase artists’ music, subscribe to paid podcast content, or purchase merchandise through our platforms or our artists' and podcasts' specific sites. In certain instances, you may be directed to an externally hosted web page or separate e-commerce site to complete your financial transaction. These third-party sites will be clearly identified and linked to their own independent privacy policies so you know exactly which company is collecting your financial and personal information. You should refer directly to those external policies for any privacy-related concerns regarding your purchase or subscription.

3. Other Sources of Information

We may receive personal information about you from third-party sources and may combine this information with the information we already maintain about you. These external sources include:

  • Artists: Marketing information from new or partnering artists that is integrated with your existing profile to build a more tailored fan experience.

  • Business Partners: Co-promotional contest providers, marketing partners, sub-contractors handling technical, payment, and delivery services, advertising networks, and analytics providers.

  • Platform Integrations: Third-party applications and services that enable single sign-on functionality or social network integration.

  • Public Databases: Information obtained from legally permissible, publicly available databases.

  • Streaming & Social Media Platforms: Music or video streaming sites and social media networks. If you participate in specific interactive features on our platforms (such as artist pre-save campaigns) that connect to your external profiles, we will collect the specific information you have authorized those platforms to share. We encourage you to review your privacy settings on those third-party services to control what information is shared with us.

  • Publicly Disclosed Content: Information you post openly on our platforms, artist pages, podcast channels, or community spaces (such as message boards, chat rooms, games, and interactive forums). Any photographs, text, music, videos, or comments you submit to these forums become public information.

The information derived from these external sources helps us update, expand, and analyze our records, accurately identify new customers, prevent fraudulent account activity, and provide targeted content, music recommendations, and services that may be of interest to you.

3.1 Information Sharing and Disclosures

We do not sell your personal information. However, we may share or disclose your personal information with select third parties for necessary business and commercial purposes, including:

  • Service Providers: Companies that assist us with operational business activities (e.g., shipping and processing orders, platform hosting, customer service administration, email newsletter delivery, and data analysis).   • Legacy Artists: Former Music Grant recording artists or their representatives. These parties will be contractually advised that your ongoing explicit consent is required for their continued use of your information.

  • Legal & Law Enforcement Mandates: Regulatory bodies, courts, or law enforcement as required by law, such as to comply with a subpoena, valid search warrant, or identical legal process.

  • Safety & Fraud Prevention: When we believe in good faith that disclosure is necessary to protect our legal rights, protect your personal safety or the safety of others, investigate system fraud, or respond to an official Canadian government request.

  • Corporate Transactions: Prospective buyers, investors, or corporate entities in connection with a major structural change, including a corporate merger, acquisition, restructuring, or asset sale.

  • Collection Societies: Applicable music collection societies, strictly if you are an independent artist or label client and explicitly direct us to transfer this information to them.

4. Social Networks, Online Communities, and Widgets

Community Forums and User Submissions

We enable you to create a profile to access blogs or online communities and share user submissions. User Submissions on our Sites may be subject to separate terms & conditions made available before submission. To participate in certain Community Forums, you may be asked to select a username, screen name, or member name and password; please do not use your actual name or email address or the actual name of another person when selecting a username.

Please be aware that information posted in community forums is public, and Music Grant Inc. cannot control how others use this content. By choosing to voluntarily share information in these areas, you acknowledge that such disclosures are not covered by this policy. We recommend exercising caution when sharing personal details. Furthermore, we may analyze forum activity and user submissions for internal analytics and marketing purposes.

Social Network Integrations

We may allow you to post content from our platforms directly to your profiles on external social networks. You can access these features using Meta/Facebook Login, X (formerly Twitter), or other open authentication providers. These external services will verify your identity and allow you to share specific information directly with that platform.

Please be aware that the external platform's privacy policy governs any content you share with them. We do not allow these third-party networks to transfer your personal information back to our platform unless you provide explicit consent.

Interactive Widgets

Our platforms may feature interactive mini-programs created by other companies (such as digital news feeds, music players, or "like" and "share" buttons), known as widgets. You may be given the opportunity to submit personal information, such as an email address, directly through a widget. Public Content Removal Requests

To request the removal of your personal information from our active blog or Community Forums, please contact the designated Privacy Officer via the contact methods provided on the website. If we are legally or technically unable to delete your specific public information (for example, if your text is deeply embedded in a discussion thread), we will respond to your request and clearly outline the applicable reasons.

You can choose to stop receiving newsletters, updates, or marketing emails from us at any time. To opt out, follow the "unsubscribe" link included at the bottom of our electronic communications. If you choose to join a Music Grant mobile marketing list, please note that standard messaging and data rates may apply depending on your wireless carrier and mobile plan. Check with your mobile provider before signing up. To stop receiving SMS (text) or MMS (multimedia) messages, reply directly to our message with the word “STOP”.

We may also send transactional or promotional push notifications to your device. You can revoke permission for these notifications at any time through your device or application settings. To ensure notifications function correctly, we collect necessary device technical telemetry, such as operating system types and user identification tokens.

Geolocation Controls

Canadian and U.S. Data Operations

Our primary digital infrastructure and platforms are operated in the United States. Because we are a subsidiary of our parent entity, Music Grant Inc., located in California, the personal information we collect from Canadian users will be transferred to, stored, and processed in the United States. If you do not reside in the U.S., your personal information may be processed by Music Grant Inc. and other Music Grant Inc.-affiliated companies on behalf of the Music Grant Inc. entity controlling personal information for your jurisdiction.

Music Grant Inc.'s international transfer of personal data collected in the European Economic Area, the United Kingdom, and Switzerland is governed by Standard Contractual Clauses (SCCs).

Asia-Pacific Economic Cooperation (APEC) Protocols

Music Grant Inc.'s international transfer of personal information collected in participating Asia-Pacific Economic Cooperation (APEC) countries abides by the APEC Cross-Border Privacy Rules (CBPR) Systemand Privacy Recognition for Processors (PRP) System for the transfer of personal information. People’s Republic of China (PRC)

12.1 Identity Verification, Non-Discrimination, and "Shine the Light"

Identity Verification Protocols

To process your rights of access, portability, deletion, and correction, we will take reasonable steps to verify your identity based on the information you provide. You may be asked to provide additional proof of identification so that we can validate the request. If we cannot verify your identity to a sufficient level of certainty, we will notify you promptly and explain the technical or legal reasons why.

In accordance with the CCPA, we will not require you to verify your identity beyond the absolute necessary data elements when you choose to exercise your rights to opt out of the sharing of your personal information. Submitting a request under the CCPA does not require you to create an account with us, and we will strictly use any additional verification details you provide solely to authenticate your identity. Please note that you are limited by law in the number of comprehensive data access requests you may submit per calendar year.

California “Shine the Light” Disclosures

Pursuant to California Civil Code Section 1798.83, California residents have the right to request a notice identifying the categories of personal information we have shared with third parties for their direct marketing purposes during the preceding calendar year, along with the names and addresses of those third parties. We set forth above in this Privacy Policy the categories of personal data (as defined under Virginia law) we process, the purpose for processing personal data, the categories of personal data shared, and the categories of third parties with whom personal data is shared.

If you are a Virginia consumer (as defined under Virginia law) and would like to exercise your rights pursuant to the Virginia Consumer Data Protection Act and any implementing regulations adopted thereunder (“VCDPA”) to submit a request, please submit a written request directly to our Privacy Officer at contact@musicgrant.ca or call our toll-free compliance line at 1-866-884-7268.

Virginia Consumers have the following rights, all subject to the meanings and exceptions set forth in the VCDPA:

  • Access: The right to confirm whether we are processing your Personal Data and request to access such data.

  • Correction: The right to request that we correct inaccurate Personal Data we hold about you.

  • Deletion: The right to request that we delete the Personal Data provided by you or obtained about you.

  • Portability: The right to obtain a copy of the Personal Data previously provided by you to us and, to the extent feasible, in a readily usable format to allow data portability.

  • Opt-Out Rights:

    • Targeted Advertising: The right to opt out of the processing of your Personal Data for the purposes of targeted advertising. Music Grant engages in online advertising practices (and certain analytics or similar activities) that may be considered “targeted advertising” under the VCDPA. To disable sharing through cookies set by third parties that may be considered targeted advertising under the VCDPA, please refer to the “Manage Cookies” link in the cookie banner of the applicable Site.

    • Sale: The right to opt out of the processing of your personal data for the purposes of a sale as defined under the VCDPA. Music Grant does not sell Personal Data to third parties for monetary compensation or other valuable consideration, and therefore, we do not offer such opt-out rights at this time.

    • Profiling: The right to opt out of the processing of your personal data for the purposes of profiling as defined under the VCDPA. Music Grant does not undertake profiling activities resulting in a legal or similarly significant effect on the individual, and therefore we do not offer such opt-out rights at this time.

VCDPA Appeals Process

Pursuant to the VCDPA, if, for any reason, you would like to appeal our decision relating to your consumer data request, you have the right to submit an appeal. You can do so by emailing our Privacy Officer at contact@musicgrant.ca with the subject line "VCDPA Appeal Request" or by calling our toll-free number: 1-866-884-7268. Please include your full name, the date of your original request, the basis for your appeal, and any additional information or context you wish us to consider. If your appeal is denied, you maintain the legal right to submit an official complaint regarding our determination directly to the Virginia Attorney General’s Office Consumer Protection Portal.

14. Universal U.S. State Privacy Addendum

(This section applies strictly to residents of U.S. states with comprehensive consumer privacy laws, excluding California and Virginia which are governed by separate sections above).

14.1 Consumer Privacy Disclosures

Depending on your state of residence (including but not limited to Colorado, Connecticut, Utah, Texas, Oregon, and Florida), local statutes require clear transparency regarding how we handle your personal data.

  • Categories and Sources of Data Collected: The categories of personal data we collect, the sources from which we obtain it, and the commercial business purposes for its use are explicitly itemized in Section 2, Section 3, and Section 5 of this Privacy Policy.

  • Data Disclosures and Third-Party Sharing: We do not sell your personal data to third parties for monetary compensation. However, we engage in standard digital advertising practices that utilize tracking technologies. These practices may be legally categorized as a "sale," "share," or processing for "targeted advertising" under your state’s specific laws. The entities with whom we share this information for operational business purposes are detailed in Section 3.1.

14.2 Your State Privacy Rights

Subject to specific statutory thresholds, local exceptions, and verification protocols in your home state, you may maintain the following consumer rights:

  • Right to Know and Access: Confirm whether we process your personal data and request a portable, readily usable copy of your information file.

  • Right to Correct: Request that we fix inaccuracies or incomplete details in your personal data file.

  • Right to Delete: Request the permanent deletion of personal data provided by or obtained about you.

  • Right to Opt-Out of Targeted Advertising and Sales: Request to opt out of the processing of your personal data for targeted behavioral advertising, cross-contextual marketing, or profiling that produces legally significant effects.

14.3 How to Exercise Your Rights and Submit Appeals

  • Opt-Out Mechanics: To block cookie-based targeted tracking instantly, adjust your browser settings or click the "Manage Cookies" link in our website footer's consent banner.

  • Identity Verification: We will verify your identity using the data you provide. We will not require you to create an account to process a rights request.

  • The Appeals Process: If we decline to take action on your consumer privacy request, you have the right to appeal our decision. Submit your appeal via email to our Privacy Officer at contact@musicgrant.ca with the subject line "State Privacy Request Appeal." We will respond to your appeal within the statutory timelines mandated by your home state (typically 45 to 60 days). If your appeal is denied, you may contact your state's Attorney General to submit a formal consumer complaint.
